Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and Cobalt Forge Games ("Cobalt Forge Games", "we", "us", or "our") governing your use of our games — including Wormy's Descent — the website at cobaltforgegames.com, and related services (together, the "Services"). The software licence for our games is set out in our separate End-User Licence Agreement (EULA), and how we handle data is described in our Privacy Policy and Cookie Policy.

1. Eligibility
The Services are intended for a general audience and are not directed to children under 13. You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Services. If you are under the age of majority where you live, you may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms.
2. Licence to use the game
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use one copy of our games on a device you own or control, solely for your personal, non-commercial entertainment. We reserve all rights not expressly granted. The full software licence, including licence restrictions, is set out in our End-User Licence Agreement; if there is any conflict regarding the software licence, the EULA governs.
You may not: (a) copy, modify, or create derivative works of the Services except as allowed by law; (b) reverse engineer, decompile, or disassemble any part of the Services except to the extent that restriction is prohibited by applicable law; (c) rent, lease, lend, sell, redistribute, or sublicense the Services; or (d) remove any proprietary notices.
3. Your account
A game account is created automatically (anonymously) when you start playing, and you may optionally link a Google Play Games or Apple account to back up and restore your progress. You are responsible for activity that occurs through your account and for keeping any linked sign-in credentials secure. We are not liable for loss of progress caused by device loss, uninstalling the game, or declining cloud save. You may delete your account at any time using the in-game Delete Account option.
4. Virtual items & currency
Our games may include virtual currencies (for example, premium and soft currencies) and virtual items such as tools, upgrades, and cosmetics ("Virtual Items"). Virtual Items:
- are licensed to you, not sold, and you receive only a limited right to use them within the game;
- have no monetary value, cannot be redeemed for real money, and cannot be transferred or sold outside the game;
- may be created, managed, modified, or removed by us, and are non-refundable except where required by applicable law or the applicable app store's policies; and
- are forfeited if your account is terminated for breach of these Terms or if the game is discontinued (see "Updates & availability").
5. Purchases & billing
In-app purchases are sold and processed by the platform through which you obtained the game — the Apple App Store or Google Play — and are subject to that platform's terms and payment methods. We do not process or store your payment card details. Prices and available items may change. Refunds are handled according to the applicable app store's policy and your statutory rights; in the EU, your statutory right of withdrawal may not apply once delivery of digital content has begun with your prior consent.
6. Advertising
Our games may display advertising, including optional rewarded ads that grant an in-game benefit in exchange for viewing them. Advertising is provided through third-party ad partners as described in our Privacy Policy. We are not responsible for the content of third-party ads or the products or services they promote.
7. Acceptable use
You agree not to: use cheats, bots, automation, or unauthorized third-party software; exploit bugs to gain an unfair advantage; tamper with, or attempt to gain unauthorized access to, the Services or other users' accounts; interfere with the normal operation of the Services; or use the Services for any unlawful purpose.
8. Intellectual property
The Services and all associated content — including the games, characters (such as Wormy), artwork, audio, text, software, trademarks, and the Cobalt Forge Games name and logo — are owned by us or our licensors and are protected by intellectual-property laws. These Terms do not grant you any right to our trademarks or branding.
9. Feedback
If you send us feedback, suggestions, or ideas about the Services, you grant us a perpetual, irrevocable, worldwide, royalty-free licence to use them for any purpose without obligation or compensation to you.
10. Updates & availability
We may update, modify, suspend, or discontinue all or part of the Services (including individual games, features, or Virtual Items) at any time, with or without notice. We are not liable to you for any modification, suspension, or discontinuation of the Services, subject to your mandatory statutory rights.
11. Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure. Nothing in these Terms excludes or limits any warranty or right that cannot be excluded or limited under applicable law, including mandatory consumer-protection rights under EU and Romanian law.
12. Limitation of liability
To the fullest extent permitted by law, Cobalt Forge Games will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the Services. Our total aggregate liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid us for the Services in the twelve months before the claim, or (b) EUR 50. These limitations do not apply to liability that cannot be limited under applicable law (for example, for death or personal injury caused by negligence, fraud, or your mandatory consumer rights).
13. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Cobalt Forge Games from any claims, damages, or expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.
14. Termination
You may stop using the Services and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Services. Provisions that by their nature should survive termination (including sections 8, 9, 11–13, and 15) will survive.
15. Governing law & disputes
These Terms are governed by the laws of Romania and, where applicable, the European Union, without regard to conflict-of-laws rules. The courts of Romania will have jurisdiction over any dispute, except that this does not deprive you of the protection of mandatory consumer-protection laws or the right to bring proceedings in the courts of your country of residence where EU law so provides. EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
16. App-store additional terms
Apple App Store
If you obtained a game from the Apple App Store, you acknowledge that: these Terms are between you and Cobalt Forge Games only, not Apple, and Apple is not responsible for the game or its content; Apple has no obligation to provide maintenance or support for the game; in the event the game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any), and to the maximum extent permitted by law Apple has no other warranty obligation; Apple is not responsible for addressing any claims by you or a third party relating to the game, including product-liability, legal-or-regulatory, and consumer-protection claims; Apple is not responsible for investigating or resolving any third-party intellectual-property claim relating to the game; you comply with applicable third-party terms and are not located in a country subject to a U.S. Government embargo or listed as a prohibited party; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google Play
If you obtained a game from Google Play, your use is additionally subject to the Google Play Terms of Service.
17. Changes to these Terms
We may revise these Terms from time to time. When we make material changes, we will update the "Last updated" date and, where appropriate, notify you in the game or on the website. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
